This Privacy Policy describes how we collect, use, disclose, retain, and protect personal information and explains the privacy rights and choices that may be available to you.

This Privacy Policy applies to personal information collected through Mad Barn websites, including MadBarn.com and MadBarn.ca, and through other interactions with Mad Barn, including when you purchase products, create or use a customer account, manage a subscription, communicate with our customer service, nutrition, or veterinary teams, submit information about your horse, subscribe to communications, participate in promotions, submit reviews or other content, apply for employment, or otherwise interact with us.

1. Personal Information We Collect

The personal information Mad Barn collects depends on the nature of your relationship and interactions with us. We may collect identification and contact information such as your name, email address, telephone number, billing address, shipping address, country, and postal or ZIP code. We may also collect customer account information, login credentials, communication preferences, subscription information, and other information associated with your account.

When you purchase products or otherwise transact with Mad Barn, we collect commercial and transaction information including products purchased or considered, order history, order dates, returns, discounts, subscription activity, customer status, and related purchasing information. Payment information may be collected and processed by payment service providers in connection with your transaction. Mad Barn does not use payment card information for advertising audience matching.

If you use features that allow you to provide information about your horse, we may collect horse profile information, feeding information, diet information, and other information that you choose to associate with your account or communications with Mad Barn. Information about an animal is not itself personal information, but it may form part of information associated with an identifiable customer account.

We may collect information contained in communications you send to us, including customer service inquiries, nutrition consultations, survey responses, product reviews, testimonials, promotion entries, and other information you voluntarily provide.

When you visit or interact with our websites, we and our service providers may automatically collect information concerning your browser, device, and use of our websites. This may include your Internet Protocol address, browser type, device type, operating system, referring website, pages viewed, products viewed, links selected, session information, advertising interactions, approximate geographic location derived from an IP address, and other information concerning your interaction with our websites and digital communications.

2. How We Collect Personal Information

Mad Barn collects personal information directly from you when you place an order, establish or use an account, contact us, request a consultation, subscribe to communications, enter a promotion, submit a review, apply for employment, or otherwise provide information to us.

We also collect certain information automatically through cookies, pixels, tags, server logs, analytics technologies, advertising technologies, and similar tools when you visit or interact with our websites or digital communications.

We may receive personal information from service providers and business partners that assist us with ecommerce operations, payments, order fulfillment, shipping, customer communications, analytics, advertising, fraud prevention, security, and other business functions. We may also receive campaign, attribution, audience, or advertising performance information from advertising platforms with which we work.

3. Consent

Where consent is required by applicable law, Mad Barn obtains consent appropriate to the nature and sensitivity of the personal information and the purposes for which the information is collected, used, or disclosed. Depending on the circumstances and applicable law, consent may be express or implied.

You may withdraw consent to certain uses or disclosures of your personal information, subject to legal or contractual restrictions and reasonable notice. Withdrawal of consent may affect our ability to provide services that depend upon the relevant information, but Mad Barn will not require consent for a purpose that is not necessary to provide a product or service except where permitted by law.

4. How We Use Personal Information

Mad Barn may use personal information to process, fulfill, deliver, and administer orders; manage customer accounts and subscriptions; provide customer service, nutrition support, veterinary support, and other services requested by customers; communicate concerning orders, deliveries, accounts, subscriptions, product information, and customer inquiries; administer promotions and other programs; and maintain records relating to customer transactions and relationships.

We may also use personal information to operate, maintain, secure, personalize, and improve our websites, products, and services; conduct analytics, research, forecasting, and business reporting; understand customer preferences and purchasing patterns; measure website and advertising performance; prevent fraud and misuse; protect our systems and customers; comply with legal, regulatory, tax, accounting, and contractual obligations; establish, exercise, or defend legal claims; and support mergers, acquisitions, financings, reorganizations, sales of assets, or similar corporate transactions.

Where permitted by applicable law, Mad Barn may use personal information to communicate marketing, educational information, product announcements, offers, and other information that may be of interest to you. You may unsubscribe from promotional communications at any time as described below.

5. Cookies, Analytics and Advertising

Mad Barn and our service providers use cookies, pixels, tags, web beacons, server-side events, analytics tools, advertising technologies, and similar technologies to operate our websites, maintain sessions and preferences, understand how visitors interact with our websites, measure website and advertising performance, prevent fraud, improve our services, and support advertising activities.

These technologies may collect or receive information concerning your browser or device, IP address, pages and products viewed, purchases, referring websites, interactions with advertisements or communications, and other website activity. Some of this information may be associated with a particular browser, device, customer account, or other identifier.

Mad Barn may use website activity, purchase history, customer status, and other information to create customer segments and advertising audiences, distinguish existing customers from prospective customers, exclude certain existing or recent customers from particular advertising campaigns, re-engage customers, measure advertising effectiveness, and improve the relevance and efficiency of advertising.

We may provide customer identifiers such as an email address, telephone number, name, country, or postal or ZIP code to advertising platforms, including Google, for customer matching, advertising audience, measurement, exclusion, and related advertising purposes. Where supported, identifiers may be hashed or otherwise protected before transmission. Hashing transforms an identifier into a standardized value for matching purposes, but information used in this manner may still constitute personal information under applicable privacy law and is treated accordingly by Mad Barn.

Purchase history, order dates, and customer relationship information may also be used by Mad Barn to determine which advertising audience or customer segment is appropriate. Mad Barn does not provide payment card information to advertising platforms for customer audience matching.

Some advertising activities may be considered targeted advertising, cross-context behavioural advertising, “sharing,” or a “sale” under particular privacy laws even where Mad Barn does not receive monetary payment for personal information.

Where required by applicable law, Mad Barn obtains appropriate consent before activating non-essential cookies or similar technologies and provides mechanisms through which users may manage applicable privacy and advertising choices.

6. Disclosure of Personal Information

Mad Barn may disclose personal information to service providers and other organizations where reasonably necessary for the purposes described in this Privacy Policy. These organizations may include ecommerce and website providers, hosting and information technology providers, payment processors and financial service providers, shipping and fulfillment providers, customer service and communications providers, analytics providers, advertising platforms and marketing service providers, security and fraud-prevention providers, professional advisers, auditors, insurers, and other organizations that support Mad Barn’s operations.

Mad Barn may disclose information to advertising platforms and related service providers for advertising, audience matching, attribution, measurement, campaign management, and related purposes as described in this Privacy Policy.

We may also disclose personal information where required or permitted by applicable law, including to courts, regulatory authorities, government agencies, or law enforcement. Personal information may also be disclosed in connection with an actual or proposed merger, acquisition, financing, restructuring, reorganization, sale of assets, or similar corporate transaction, subject to applicable legal requirements.

Where an organization processes personal information on Mad Barn’s behalf, we take reasonable steps appropriate to the circumstances to require the organization to protect the information and process it consistently with applicable contractual and legal requirements.

7. Where Personal Information Is Processed

Mad Barn is based in Canada and conducts business in Canada and the United States. Some of our service providers, technology providers, advertising platforms, and other organizations that process personal information may operate or maintain systems in other provinces, the United States, or other jurisdictions.

As a result, personal information may be transferred, processed, disclosed, or stored outside your province, state, or country of residence, including outside Quebec. Personal information processed in another jurisdiction may be subject to the laws of that jurisdiction and may be accessible to courts, law enforcement, regulatory authorities, or governments in accordance with applicable law.

Where required by applicable law, Mad Barn assesses privacy considerations associated with cross-border processing and uses contractual, organizational, technical, or other safeguards appropriate to the circumstances.

8. Retention of Personal Information

Mad Barn retains personal information only for as long as reasonably necessary for the purposes for which it was collected or for other purposes permitted or required by law. The period for which information is retained depends on factors including the nature and sensitivity of the information, the duration of our relationship with the individual, the need to maintain transaction and business records, warranty and customer service requirements, fraud prevention and security considerations, and legal, regulatory, tax, accounting, and limitation-period requirements.

When personal information is no longer required, Mad Barn takes reasonable steps to securely destroy, delete, or anonymize the information in accordance with applicable law and our retention practices.

9. Privacy Rights and Choices

Depending on your place of residence and the law applicable to Mad Barn’s processing of your information, you may have rights concerning your personal information. These may include the right to request access to personal information held about you, request correction of inaccurate or incomplete information, request deletion of certain information, withdraw consent to certain uses or disclosures, obtain a portable copy of certain personal information, object to or opt out of certain advertising or profiling activities, or submit a complaint concerning our privacy practices.

Privacy rights are subject to applicable legal exceptions and limitations. Mad Barn may need to verify your identity before fulfilling certain requests and may request information reasonably necessary to complete that verification.

You may unsubscribe from promotional email communications at any time by using the unsubscribe mechanism included in the communication. Opting out of promotional communications does not prevent Mad Barn from sending transactional or service-related communications concerning orders, accounts, subscriptions, safety information, or other matters permitted by law.

Where available, advertising and cookie preferences may be managed through the privacy or cookie controls provided on our websites.

10. Information for Quebec Residents

Where Quebec privacy legislation applies, Mad Barn processes personal information in accordance with Quebec’s Act respecting the protection of personal information in the private sector and other applicable requirements.

Mad Barn collects personal information for the purposes described in this Privacy Policy and may collect such information directly from individuals, through our websites and technological tools, or through service providers and other organizations as described above. Personal information may be communicated to the categories of service providers and other organizations identified in this Privacy Policy where necessary for the purposes for which the information is collected or otherwise where permitted by law.

Personal information concerning Quebec residents may be communicated or processed outside Quebec, including elsewhere in Canada and in the United States. Where required, Mad Barn evaluates the privacy implications of such communications and implements appropriate contractual or other measures.

Mad Barn may use technologies or information to identify or recognize a browser, device, or account, determine an approximate location, or create customer profiles or segments based on information such as website activity, purchasing history, and customer status. Where Quebec law requires consent or user activation for identification, location, or profiling functionality, Mad Barn provides applicable information and controls through its website privacy and cookie mechanisms.

Subject to applicable law, Quebec residents may request access to personal information Mad Barn holds about them, request correction of inaccurate or incomplete information, and withdraw consent to certain uses or communications of personal information. Quebec residents may also have the right to obtain certain computerized personal information they provided to Mad Barn in a structured and commonly used technological format and may have additional rights concerning the dissemination or indexing of personal information in circumstances provided by law.

Questions, complaints, requests to exercise privacy rights, and other matters concerning the protection of personal information may be directed to Mad Barn’s Privacy Officer, who serves as the person responsible for the protection of personal information, using the contact information provided in Section 17 below.

11. California Privacy Notice

This section supplements the remainder of this Privacy Policy and applies to California residents to the extent that the California Consumer Privacy Act, as amended, and its implementing regulations apply to Mad Barn’s processing of personal information.

Categories of Personal Information

During the 12 months preceding the effective date of this Privacy Policy, depending upon an individual’s interactions with Mad Barn, we have collected or processed categories of personal information that may include identifiers such as names, postal addresses, email addresses, telephone numbers, IP addresses, account identifiers, and similar identifiers; customer records and contact information; commercial information, including purchase history, products purchased or considered, subscriptions, and other purchasing tendencies; internet or other electronic network activity information, including browsing and interaction information; approximate geolocation information derived from an IP address; professional or employment-related information provided in connection with employment inquiries or applications; photographs, videos, reviews, communications, or similar content submitted to Mad Barn; and inferences or customer segments derived from purchasing or website activity.

Mad Barn may also process information considered sensitive personal information under California law, such as account login credentials used to access a Mad Barn account. Payment service providers may process financial account or payment card information in connection with transactions. Mad Barn does not use or disclose sensitive personal information for the purpose of inferring characteristics about California consumers or for other purposes that would require Mad Barn to offer a right to limit such use, unless otherwise disclosed at the time of collection.

Sources and Purposes

Mad Barn obtains personal information directly from consumers, automatically through websites and digital technologies, and from service providers, advertising platforms, and other organizations described in this Privacy Policy. We collect and use these categories of personal information for the business and commercial purposes described in Sections 4 and 5 of this Privacy Policy, including providing products and services, processing transactions, managing customer relationships, communicating with customers, maintaining and improving our websites, analytics, security, fraud prevention, advertising, marketing, audience management, and legal and regulatory compliance.

Disclosure, Sale and Sharing

During the preceding 12 months, Mad Barn has disclosed or may have made available identifiers, customer records, commercial information, internet or electronic network activity information, and other information described in this Privacy Policy to service providers and other organizations that provide ecommerce, payment, fulfillment, shipping, communications, information technology, analytics, advertising, security, professional, and related services.

Mad Barn does not sell personal information in exchange for monetary payment. Mad Barn may share identifiers and internet or electronic network activity information with advertising platforms, advertising networks, or other advertising providers for cross-context behavioural advertising. Certain customer identifiers may also be provided to advertising platforms for audience matching and related advertising activities as described in Section 5. Under California law, some of these activities may constitute “sharing” even where no money is exchanged.

Mad Barn does not knowingly sell or share the personal information of consumers under 16 years of age.

California Privacy Rights

Subject to the CCPA and applicable exceptions, California residents may have the right to know what personal information Mad Barn has collected about them, including applicable categories, sources, purposes, and disclosures; access specific pieces of personal information; request deletion of personal information; request correction of inaccurate personal information; obtain certain information in a portable format; opt out of the sale or sharing of personal information; limit certain uses or disclosures of sensitive personal information where applicable; and exercise CCPA rights without unlawful discrimination or retaliation.

California residents may submit requests concerning access, correction, deletion, or other applicable privacy rights through Mad Barn’s online contact form or by contacting the Privacy Officer using the information in Section 17. Mad Barn may take reasonable steps to verify a request before responding. An authorized agent may submit a request where permitted by California law, subject to applicable verification requirements.

California residents may opt out of the sale or sharing of personal information for cross-context behavioural advertising through our Your Privacy Choices mechanism. Where required by applicable law, Mad Barn also recognizes qualifying opt-out preference signals, including Global Privacy Control, for the browser or device communicating the signal.

12. Texas Privacy Notice

This section supplements the remainder of this Privacy Policy and applies to Texas residents acting in an individual or household context to the extent the Texas Data Privacy and Security Act applies to Mad Barn’s processing of their personal data.

The categories of personal data Mad Barn processes, the purposes for processing that data, the categories of personal data that may be disclosed to third parties, and the categories of third parties to which personal data may be disclosed are described in Sections 1 through 6 of this Privacy Policy.

Mad Barn may process personal data for targeted advertising. Texas residents may opt out of targeted advertising and, where applicable, the sale of personal data through our Your Privacy Choices mechanism or by contacting Mad Barn’s Privacy Officer.

Mad Barn does not sell sensitive personal data or biometric personal data.

Subject to applicable Texas law, Texas residents may have the right to confirm whether Mad Barn is processing their personal data and access that data; correct inaccuracies; request deletion of personal data provided by or obtained about them; obtain certain personal data they previously provided in a portable and readily usable format; and opt out of processing for targeted advertising, the sale of personal data, or certain profiling activities that produce legal or similarly significant effects.

Requests may be submitted through Mad Barn’s online contact form or by contacting the Privacy Officer using the contact information provided in Section 17. Mad Barn may authenticate a request where permitted by law before fulfilling it.

If Mad Barn declines to take action on a Texas privacy request, the individual may appeal that decision by contacting the Privacy Officer and identifying the request as a “Texas Privacy Appeal.” Mad Barn will review the appeal and provide a response in accordance with applicable Texas law. If an appeal is denied, Mad Barn will provide information concerning the individual’s ability to submit a complaint to the Texas Attorney General.

Where required by Texas law, Mad Barn recognizes qualifying requests submitted through authorized agents or applicable technological opt-out mechanisms.

13. Residents of Other U.S. States

Residents of other U.S. states may have additional rights under applicable state privacy laws. Depending on the jurisdiction and whether the applicable law applies to Mad Barn, those rights may include access, correction, deletion, portability, and the ability to opt out of targeted advertising, the sale of personal data, or certain profiling activities.

Mad Barn will process qualifying privacy requests in accordance with applicable law. Individuals may submit requests through the methods described in this Privacy Policy.

14. Reviews, Testimonials and Public Content

Mad Barn websites may allow customers or other individuals to submit reviews, testimonials, photographs, comments, or other content that may become publicly visible. Information posted publicly may be viewed, copied, or used by others, and individuals should consider carefully what information they choose to disclose.

Where permitted by law and consistent with applicable permissions, Mad Barn may use reviews, testimonials, photographs, or other submitted content for editorial, educational, promotional, or marketing purposes.

15. Children

Mad Barn’s websites are intended for a general audience and are not directed to children under 13 years of age. Mad Barn does not knowingly collect personal information online from children under 13 without any parental consent required by applicable law.

If we become aware that personal information has been collected from a child in circumstances in which legally required parental consent was not obtained, we will take appropriate steps consistent with applicable law.

16. Security

Mad Barn uses reasonable administrative, technical, and physical safeguards designed to protect personal information against loss, theft, misuse, unauthorized access, disclosure, alteration, and destruction. Safeguards may include access controls, encrypted communications, security monitoring, internal procedures, and measures intended to limit access to personal information to individuals and service providers that require access for legitimate purposes.

Payment transactions are processed using payment service providers and security technologies appropriate to the circumstances. Mad Barn does not provide payment card information to advertising platforms for customer audience matching.

No system, transmission method, or storage technology can be guaranteed to be completely secure. Individuals are responsible for taking reasonable steps to protect their account credentials and should not send passwords or complete payment card details to Mad Barn by ordinary email.

This Privacy Policy does not govern the independent privacy practices of third parties that are not processing personal information on Mad Barn’s behalf. We encourage individuals to review the applicable privacy policies of third-party websites and services before providing personal information to them.

19. Changes to This Privacy Policy

Mad Barn may update this Privacy Policy periodically to reflect changes to our practices, technologies, services, legal requirements, or other circumstances. When this Privacy Policy is updated, the revised version will be posted on our website and the “Last Updated” date will be revised accordingly.
