Criminal liability under the Trade Descriptions Act 1968 is first considered. There follows a discussion of civil liability at common law and under the Misrepresentation Act 1967. The paper then examines the standard of care required of a veterinary surgeon in preparing a certificate, and, after some general considerations, deals specifically with questions relating to the purpose of the examination, the extent of the examination, and testing for phenylbutazone and other drugs. A proposal for a long term solution to some of these problems is made. Résumé: Cet article examine les récentes dispositions légales qui ont accru la responsabilité civile et pénale engagée par la délivrance d'un certificat vétérinaire de bonne santé. La responsabilité pénale, telle qu'elle ressort du Trade Description Act 1968 est d'abord examinée. Puis suit une discussion sur la responsabilité civile en droit commun compte tenu du Misrepresentation Act 1967. Ensuite on examine les précautions exigibles d'un vétérinaire pour la préparation d'un certificat; après quelques considérations générales on traite en particulier des aspects en relation avec le but de l'examen des limites de l'examen et de la recherche de Phénylbutazone et d'autres médicaments.
